These Terms of Use (referred to as "Terms") regulate your utilization of Buildupshot, except in cases where we explicitly specify that distinct terms apply, not these. They also furnish details regarding the Buildupshot Service (referred to as the "Service") as outlined below. By creating a Buildupshot account or using Buildupshot, you implicitly consent to these Terms. It's important to note that the Wooflers Information Technologies Terms of Service do not extend to this Service.

Buildupshot is part of the one of products offered by Wooflers Information Technologies. Hence, these Terms of Use establish an agreement between you and Wooflers Information Technologies regarding your usage of Buildupshot.

Our aim with this service is to empower individuals to maximize their unique talents to the fullest extent possible, supported by a comprehensive suite of features. The Buildupshot Service encompasses all products, features, applications, services, technologies, and software that we offer. Our Vision and Mission revolve around providing equal opportunities for all individuals to learn, earn, and advance themselves, benchmarked against their as well as other competitors past activities within Buildupshot.

We provide you with an opportunity to showcase yourself in an open environment through user accounts. Additionally, there is an option to upgrade your account type, unlocking a range of powerful features. This allows you to create, post, connect, share, and expand your network or presence within your own professional or social circles, both within the Buildupshot Community and beyond. The features and systems within Buildupshot are designed to facilitate the discovery of meaningful relationships and shared experiences that resonate with your interests. Creating a nurturing, welcoming, and secure atmosphere is paramount to us. We equip our community with tools and resources to enhance their experiences, ensuring positivity and inclusivity. Whenever assistance is required, we proactively offer support. Our dedicated teams and robust systems actively combat abuse, violations of our terms, and deceptive behaviors. Leveraging available data, including user information, we strive to maintain platform security. Additionally, we may collaborate with other Meta Companies or law enforcement to address misuse or harmful content, as detailed in our Privacy Policy.

In order to operate our services globally, starting from India, it is necessary for us to store and transfer data across systems worldwide, including beyond your country of residence. This approach ensures a seamless experience for you. The storage and transfer of data may occur within systems owned or operated by Wooflers Information Technologies and its affiliates.

The information gathered from your Buildupshot accounts and other Wooflers Information Technologies products is utilized to present you with the best products, offerings, and sponsored content in a meaningful manner. This enhances the relevance of your user experience on Buildupshot.

The data collected through your usage of Buildupshot is also utilized to contribute to your overall well-being.

The Way we Operate our Service:

By utilizing the Service governed by these Terms, you acknowledge that instead of paying to use Buildupshot, we may display advertisements from businesses and organizations that pay us to promote their offerings both on and off the Wooflers Information Technologies Products. This involves leveraging your personal data, including details about your activities and interests, to tailor ads that are more pertinent to you.

We ensure that the ads you encounter are relevant and beneficial without divulging your identity to advertisers. Your personal data is not sold to third parties. Advertisers provide us with information about their business objectives and target audience preferences, allowing us to display ads to individuals who may have an interest.

Furthermore, we furnish advertisers with performance reports regarding the effectiveness of their ads, aiding them in comprehending how users engage with their content across Buildupshot and beyond. These reports may include general demographic and interest insights to help advertisers better understand their audience. Rest assured, we do not share information that directly identifies you unless explicit consent is provided.

You may come across branded content on Buildupshot, which is posted by account holders promoting products or services in collaboration with mentioned business partners.

We are Currently using Google Adsense and Google Admob to display ads to you. By using Buildupshot, it is obvious that you are agreed to terms and conditions of Google Adsense and Google Admob.

Any individual ("User") accessing Buildupshot or the Buildupshot App ("Buildupshot platform") to participate in various contests available on the Buildupshot platform ("Contests") ("Buildupshot Services") shall be bound by these Terms and Conditions, as well as all other rules, regulations, and terms of use provided by Buildupshot in relation to any individual Contest displayed in Buildupshot Services.

Buildupshot reserves the right to modify these Terms and Conditions, rules, regulations, and terms of use related to any Buildupshot Services at any time by posting them on Buildupshot. By using Buildupshot, the User accepts such Terms and Conditions, rules, regulations, and terms of use, as may be amended periodically. Buildupshot may, at its discretion, notify Users of any changes by sending an email to their registered email address or posting notifications in their accounts. Users have the option to indicate non-acceptance of modified terms within the specified timeframe; otherwise, they will be deemed to have accepted the modifications.

Certain Buildupshot Services may be subject to additional rules and regulations, which prevail over these Terms and Conditions if they are inconsistent.

Buildupshot reserves the right to:

Restrict, suspend, or terminate any User's access to all or part of Buildupshot or Buildupshot Platform Services;

Change, suspend, or discontinue all or part of the Buildupshot Platform Services;

Reject, move, or remove any material submitted by a User;

Move or remove any content available on the Buildupshot Platform;

Establish general practices and limits concerning the use of the Buildupshot Platform;

Assign its rights and liabilities to all User accounts to any entity (with notification to all Users' registered email addresses).

Buildupshot may, at its discretion, restrict, suspend, or terminate a User's access to Buildupshot Contests or the Buildupshot Platform, deactivate or delete the User's account and related information, delete any User-posted content on Buildupshot, and take necessary technical and legal steps if it believes a User has breached these Terms and Conditions or has illegally or improperly used Buildupshot or Buildupshot Services.

If Buildupshot charges Users a platform fee for any Buildupshot Services, it shall promptly refund such fee in the event of suspension or removal of the User's account or Buildupshot Services due to negligence or deficiency on Buildupshot's part, except in cases of User breach or circumstances beyond Buildupshot's reasonable control.

Users consent to receiving communications, including announcements, administrative messages, and advertisements from Buildupshot or its partners, licensors, or associates.

Privacy Policy

Delivering our Service necessitates the gathering and utilization of your information. The Privacy Policy delineates the methods by which we collect, employ, and distribute information within the Wooflers Information Technologies Products ecosystem. It also elucidates the diverse means through which you can manage your information, including within the Buildupshot Privacy and Security Settings. Your consent to the Privacy Policy is imperative for utilizing Buildupshot.

Your Pledge

The Way to use and not to use Buildupshot:

This platform operates openly and must prioritize safety and security in compliance with the law. To uphold a better community within Buildupshot, we require your commitment to specific choices and limitations.

You are permitted to utilize Buildupshot if you are at least 13 years old or meet the minimum legal age requirement in your country of residence.

You must not be a convicted criminal or someone legally prohibited from using our service.

Individuals who have been previously blocked or disabled for violating the law or our terms are prohibited from using our service.

Impersonating others or furnishing false information is prohibited. While disclosing your identity on Buildupshot is optional, you are required to furnish precise and current information, such as registration details, which may entail providing personal data. Furthermore, you are not permitted to impersonate individuals or entities, nor can you create an account for another person without explicit consent.

You are prohibited from taking any action that disrupts or hinders the intended functioning of the Service. This encompasses the misuse of reporting, dispute, or appeals channels, such as filing fraudulent or unfounded reports or appeals.

Unauthorized creation of accounts or illicit access to information is strictly forbidden, including automated account creation or information gathering without explicit authorization from us.

It is not permitted to sell, license, or purchase any accounts or data acquired from us or our Service. This prohibition extends to attempts to trade, sell, or transfer any aspect of your account (including your username), solicit, gather, or utilize other users' login credentials or badges, or request or collect Instagram usernames, passwords, or access tokens.

Disclosure of someone else's private or confidential information without consent, or any action that violates another individual's rights, including intellectual property rights such as copyright infringement, trademark infringement, counterfeit, or piracy, is prohibited. Exceptions or limitations to copyright and related rights under applicable law may be applicable when using someone else's works. You confirm that you possess or have obtained all necessary rights to the content you post or share. Further information on reporting content that you believe infringes your intellectual property rights can be found here.

Modification, translation, creation of derivative works, or reverse engineering of our products or their components is not allowed.

Using a domain name or URL in your username without prior written consent from us is not permitted.

Your Permit us from providing this Buildupshot service:

Permissions Granted to Us: By agreeing to our terms, you also grant us the necessary permissions to deliver the Service. We do not assert ownership over your content; however, you authorize us to use it.

Your rights to your content remain unchanged. We do not claim ownership of the content you share on or through the Service, and you retain the freedom to share it with others wherever you wish. Nonetheless, to provide the Service, we require certain legal permissions from you, known as a "license." When you share, post, or upload content protected by intellectual property rights (such as photos or videos) on or in connection with our Service, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (in accordance with your privacy and application settings). This license terminates when your content is deleted from our systems. You can delete content individually or altogether by deleting your account. For further details on how we utilize information and how to control or delete your content, please refer to the Privacy Policy and visit the Buildupshot Help Center.

Permission for Use of Your User Information: You grant us permission to display your username, profile picture, and details about your interactions and connections with accounts, advertisements, and sponsored content. You consent to us displaying your username, profile picture, and information regarding your interactions (such as likes) or connections (such as follows) alongside or in association with accounts, advertisements, promotions, and other sponsored content that you engage with on Wooflers Information Technologies Products, without any compensation to you. For instance, we may indicate that you liked a sponsored post created by a brand that has paid us to exhibit its advertisements on Instagram. Similar to interactions with other content and follows of other accounts, interactions with sponsored content and follows of sponsored accounts are visible only to those who have permission to view that content or follow those accounts. We will also adhere to your ad preferences.

Agreement to Receive Service Updates: You agree that we may download and install updates to the Service on your device.

Additional Rights Reserved by Us:

If you choose a username or a similar identifier for your account, we reserve the right to change it if we deem it necessary or appropriate, such as in cases where it violates someone's intellectual property rights or impersonates another user.

If you utilize content protected by intellectual property rights that we provide and make available in our Service (such as images, designs, videos, or sounds that we offer for you to incorporate into your created or shared content), we maintain all rights to our content while respecting your ownership rights.

You are only permitted to use our intellectual property and trademarks, or similar marks, in accordance with our Brand Guidelines or with our explicit prior written consent.

To modify, create derivative works of, decompile, or attempt to extract source code from our intellectual property, you must obtain written permission from us or adhere to the terms of an open-source license.

Participation Terms:

By participating in a Contest, the user agrees to abide by these Terms and the decisions made by Buildupshot. Subject to the terms outlined below, Buildupshot reserves the right, at its sole discretion, to disqualify any user from a Contest, withhold benefits or prizes, and demand the return of any prizes, should the user engage in conduct deemed by Buildupshot to be unfair, improper, or detrimental to the operation of the Contest or to other Users. Such conduct includes, but is not limited to:

Providing false personal information (including, but not limited to, name, email address, bank account details, or any other requested information or documentation by Buildupshot to enter a contest or claim a prize).

Involvement in financial fraud or misrepresentation, including unauthorized use of credit/debit instruments, payment wallet accounts, etc., to participate in a Contest or claim a prize. The burden of proof to the contrary rests solely on the user.

Collaborating with other users or engaging in syndicate play.

Violating Contest rules or the Terms of Use.

Accumulating likes or prizes through unauthorized methods such as automated bots or other automated means.

Utilizing automated means (including, but not limited to, harvesting bots, robots, parsers, spiders, or screen scrapers) to acquire, gather, or access any information on the Website or about any User for any purpose.

Attempting to tamper with the administration of a Contest or computer programs, or any associated security measures.

Obtaining other users' information without their express consent and/or knowledge, or engaging in spamming other users (which may include, but is not limited to, sending unsolicited emails or bulk emails to Buildupshot Users, sending unwarranted email content either selectively or in bulk).

Misusing the Website in any manner (examples include the use of unparliamentary language, slangs, or disrespectful words).

It is clarified that in the event of a User's violation of this policy, Buildupshot reserves the right to pursue appropriate civil or criminal remedies as advised, in addition to forfeiture and/or recovery of any prize money.

Contest Registration:

To register for the Contest(s), Participants must pay “Participation fee” as specified by providing:

Email address
Phone Number

By paying fee Participants confirm that they have read and agree to abide by these Terms and Conditions.

Contests, Participation, and Prizes:

As part of its services, Buildupshot may offer various contests on the Buildupshot platform.

Individual users, referred to as "Participants," are invited to Make their participations.

Participants may edit, delete, disable comments, boost post to their content posted any time after their participation, Contest Prizing is only considered based one the parameters recorded on the said participation dates and timings under contest rules and regulations.

Buildupshot reserves the right to adjust specific contests deadlines or abandon contests in certain unforeseen scenarios beyond its reasonable control, including:

No shown up or less number of participation as considered by Buildupshot, of participants to one or more contests published. In such case user/participant will be refunded his participation fees.
Any false Software mal-practices found and notified.

Participants with the highest Likes Count in the said Contest are declared Winners after verification of any false utilization of service provided by Buildupshot. In certain Contests, there may be multiple Winners, and prizes are distributed in manner explained under each contest section rules and regulations.

Contests across Buildupshot Services are governed by the Contest Rules and Regulations displayed under each Contest section on the How to participate for each respective contest, along with other rules and regulations, including payment rules, which Participants agree to follow.

Currently, paid versions of Contests are available on the Buildupshot platform. Participants can join by paying a pre-designated amount specified on the relevant Contest page. The pre-designated amount includes platform fees and participants' contributions towards prize money. The Participant with the highest aggregate “likes count” respected to their participated content at the end of the predetermined timeline a designated prize will be announced and distributed.

Participants are required to pay a pre-designated amount to participate in Contests on the Buildupshot platform.

In contests with two or more participants posting same data, the following consequences will be done.

Participants will be given a chance to prove their content is theirs own.
Participants will be given a day time two respond, failed to respond participants will be deemed to be violating terms and conditions of Buildupshot and will be removed from contest and in some cases, they might also get their account blocked/deleted to have in Buildupshot. This act of taking decision is solely Buildupshot’s discretion.

In any particular contest, participants having attained same “Likes count” for their participated content at the time of consideration of winners at “end date of contest”, the following measures will be done,

Participants might get a chance to take data of content from one more day after end date, for consideration of likes count.
Participants might get to share prize money equally.

Prizes to any said contest are announced in “Rules and Regulations” of a contest and displayed at respective contest viewing page.

Prizes announced might be of cash prizes or voucher prizes or any other as said and published under “Rules and Regulations” of a contest.

Prizes thus announced are distributed to participants who are declared to be winner by Buildupshot, after due process paying relevant taxes by law of land from “Announced Prize amount” to the winners.

Example of Prize amount Distribution:

Contest Total Reward amount: Rs.50000/-

Participants would get: 35000/- by hand and 15000/- (30% of Prize amount filed as TDS under participant name)-TDS varies based on the Law of Land regulation and which would be informed to participants before prize distribution.

Reward Points System:

Currently Platform is having a rewards points system, where user can get points based on the activities, he does in using Buildupshot.

Current System points valuation:

For Like to any content in Buildupshot, user gets 5 points
For Comment to any content in Buildupshot, user gets 5 points
For posting and new content in Buildupshot, user gets 10 points
Every 100 points is equal to Rs.1/- (one Indian rupee)

This system of generating reward points and thereby redemption to cash is sole discretion of Buildupshot, and Buildupshot can change these valuations to reward certain activities and to stop all reward point activities. User can only avail these reward points and redemption till Buildupshot decides to do so. No one can complain against Buildupshot, if further this Reward Point system and redemption of cash is stopped to serve the User.

Tax Liability

All prizes will be subject to tax deduction at source ("TDS") in accordance with the provisions of the Income Tax Act, 1961. Effective April 1, 2023, a TDS rate of 30% will be applied to Net Winnings. Winners will receive TDS certificates for the tax deductions made.

Winners are responsible for paying any other applicable taxes, including but not limited to income tax, gift tax, etc., on their Net Winnings. Buildupshot shall not be liable for any individual tax matters of users.

Notifying Winners

Winners will receive communication from Buildupshot or the designated third party via the email address provided during registration. At this stage, Winners will receive instructions regarding the verification process and the necessary documents needed to claim their prize. Typically, Winners will be asked to provide the following documents:

- Copy of the User's PAN card

- Copy of a government-issued proof of residence

- Bank account details and supporting documentation

Buildupshot will not authorize the distribute of prizes or accumulated winnings until the aforementioned documents have been received and verified within the specified timeframe. Participants are responsible for ensuring they provide accurate and complete details during registration. Buildupshot shall not be liable for any communication errors, omissions, or commissions, including those attributable to Participants, which may result in the failure to communicate results to the Winner.

The list of Winners will be published on a dedicated webpage on the Buildupshot platform, and. If a Participant is listed as a Winner on the webpage but has not received communication from Buildupshot, they may contact Buildupshot within the specified timeframe mentioned on the webpage.

Additional Points:

Buildupshot's decisions regarding prize awards are final, binding, and not subject to dispute.

Participants engaging in the paid formats of the Contest(s) affirm that they are not residents of the India, Buildupshot will disqualify them, forfeit any prizes won, and may choose to suspend or terminate their account.

If a Participant in the paid formats is found to be under the age of thirteen (13), Buildupshot reserves the right to disqualify them, forfeit their prize, and may suspend or terminate their account.

If a Participant does not pose PAN for accounting and transaction, he will be given a chance to use their parent’s payment details to get paid reward prize money, of which parents’ consent is needed.

Buildupshot provides no warranties regarding the quality, suitability, or merchantability of prizes and shall not be held liable in this regard.

Buildupshot reserves the right, at its discretion, to alter or adjust the prizes offered to winners. Participants cannot challenge Buildupshot's authority to modify these prizes before the Contest concludes.

Buildupshot assumes no responsibility for the transportation or packaging of prizes to winners and shall not be liable for any loss or damage occurring during transportation.

Winners are responsible for bearing shipping, courier, or any other delivery costs associated with receiving their prizes.

Winners are also responsible for covering any transaction charges incurred in delivering cash prizes.

All prizes are non-transferrable, non-refundable, and cannot be exchanged or redeemed for cash or other items. Cash claims in lieu of prizes will not be entertained.

Publicity:

By accepting and Participating in a Contest, the Winner grants Buildupshot and its affiliates permission to utilize the Winner's name, image, voice, posted content and remarks for advertising and promotional endeavors across all media platforms worldwide, for advertising and commercial purposes, without requiring any further permissions, consents, or additional compensation whatsoever.

Winners also agree to make themselves available for promotional activities as per Buildupshot's plans and requirements, without any charges. The specific dates for such activities will be determined solely by Buildupshot. Promotional events may encompass press conferences, internal gatherings, and ceremonies/functions, among other activities.

General Terms:

Should Buildupshot become aware of any governmental, statutory, or regulatory requirements or approvals necessary for the conduct of any Contest(s), or if Buildupshot learns that conducting such Contest(s) is prohibited, Buildupshot reserves the right to withdraw or cancel such Contest(s) without prior notice to Participants or winners. Users agree not to make any claims regarding such cancellation or withdrawal, nor contest it in any way.

Employees are ineligible to participate in any Contest(s).

How we Handle user Reports, Abuse and User Content Violations:

Since the Buildupshot platform provides users with the ability to create their own content, if a user uploaded or shared or verbally misbihaved with any abusive or content that violates the Terms of Use and Policies of Buildupshot, our team will diligently monitor through the reporting system available to each user. This reporting system allows users to report any observed violating content while browsing through the platform. Additionally, Team@Buildupshot consistently verifies for any instances of violations such as abusive content, nudity, or breaches of the Terms of Use and Policies. We ensure prompt responses to such reports within 24 hours.

Content Removal and Account Disabling or Termination:

We reserve the right to remove any content or information shared on the Service if we believe it violates our Terms of Use, our policies (including the Buildupshot Community Guidelines), or if such removal is required or permitted by law. Additionally, we may refuse to provide or cease providing all or part of the Service to you, including terminating or disabling your access to Wooflers Information Technologies Products and Wooflers Information Technologies Products, immediately if we determine it necessary to safeguard our community or services, or if your actions pose risks or legal exposure for us. This includes instances where you violate our Terms of Use or policies (including the Buildupshot Community Guidelines), repeatedly infringe on others' intellectual property rights, or where required or permitted by law. We also reserve the right to terminate or modify the Service, remove or block content or information shared on our Service, or cease providing all or part of the Service if we determine it reasonably necessary to mitigate adverse legal or regulatory impacts on us. If you believe your account has been terminated in error, or you wish to disable or permanently delete your account. Upon your request to delete content or your account, the deletion process will commence automatically within 30 days. It may take up to 90 days to delete content after the deletion process begins. During the deletion process, the content will no longer be visible to other users but will remain subject to our Terms of Use and Data Policy. After the content is deleted, it may take us an additional 90 days to remove it from backups and disaster recovery systems. Content will not be deleted within 90 days of the account deletion or content deletion process beginning in certain situations, such as when your content has been used by others in accordance with the license provided herein and they have not deleted it, or when deletion within 90 days is not feasible due to technical constraints of our systems. In such cases, the content will be retained for no longer than necessary for the purposes it was retained. If your account is deleted by you or disabled by us, these Terms shall terminate as an agreement between you and us; however, the sections entitled "Content Removal and Account Disabling or Termination" and "Our Agreement and What Happens if We Disagree" will continue to apply even after termination, disabling, or deletion of your account.

Our Agreement and Dispute Resolution:

Our agreement with you encompasses various aspects, including your usage of music on the Service, which is subject to our Music Guidelines, and your utilization of our API, which is governed by our Buildupshot Terms and Developer Policies. If you engage with specific features or related services, additional terms will be provided and will be considered part of our agreement. For instance, if you utilize payment features, you will need to consent to the Community Payment Terms. In the event of a conflict between any of these terms and the present agreement, the conflicting terms will take precedence.

If any portion of this agreement proves unenforceable, the remaining provisions will remain in full force and effect. Any modifications or waivers to our agreement must be documented in writing and signed by us; failure to enforce any aspect of the agreement does not constitute a waiver.

We retain all rights not explicitly granted to you under this agreement. This agreement does not confer rights upon any third parties, and you may not transfer your rights or obligations without our explicit consent. However, we reserve the right to assign our rights and obligations to others, which could occur due to changes in ownership (such as through a merger, acquisition, or asset sale) or as required by law.

Responsibility for Incidents:

We provide our Service "as is" and cannot guarantee its complete safety, security, or flawless operation at all times. To the fullest extent permitted by law, we disclaim all warranties, whether explicit or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Additionally, we do not control the actions, conduct, or content of individuals, and we are not liable for their (or your) actions or behavior, whether online or offline, or for any content, including unlawful or objectionable content. Furthermore, we are not responsible for services and features provided by other individuals or companies, even if accessed through our Service.

Our liability for incidents on the Service is limited to the maximum extent permitted by law. As we cannot foresee all potential consequences of issues with our Service, you agree that we shall not be liable for any lost profits, revenues, information, or data, or for any consequential, special, indirect, exemplary, punitive, or incidental damages arising from or related to these Terms, even if we are aware of their potential. This includes situations where we delete your content, information, or account.

Dispute Resolution:

For consumers, the laws of your country of residence apply to any claim, cause of action, or dispute arising from or relating to these Terms ("claim"), The courts having jurisdiction in Vijayawada, A.P, India, shall exclusively handle any and all disputes arising from or related to the Buildupshot Services provided by Wooflers Information Technologies (including the Contests), the interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Users (including consumers) or Buildupshot. They shall also have exclusive authority to grant interim relief in case of disputes referred to arbitration. All such matters shall be governed by the laws of the Republic of India.

In the event of any legal dispute, the party initiating the dispute must provide written notification to the other party. Arbitration proceedings shall take place in Vijayawada, A.P, India, conducted in English under the Arbitration and Conciliation Act, 1996. The arbitration award will be final and binding, with each party bearing its own arbitration costs and sharing the arbitrator's fees unless otherwise determined by the tribunal. The arbitrator may issue interim orders and awards, including orders for specific performance, which are enforceable in competent courts, accompanied by reasoned awards.

These Terms and Conditions do not prohibit Wooflers Information Technologies from seeking interim or permanent equitable or injunctive relief to protect its interests before, during, or after arbitration proceedings. Pursuing such relief does not waive Buildupshot's right to pursue monetary damages through arbitration.

Additionally, Wooflers Information Technologies. reserves the right, at its sole discretion, to bring any claim against you related to efforts to abuse, interfere with, or engage with our products in unauthorized ways in your country of residence with jurisdiction over the claim.

Any User Content you believe violates these Terms (except for Intellectual Property Rights infringements), for which the reporting mechanism for such claims can be found below;

A clear identification of the copyrighted work allegedly infringed;

A clear identification of the allegedly infringing material on the Platform;
